
New Delhi: Children of the late chairman Sony Comstar Sunjay Kapur and his ex -wife, actor Karisma Kapoor, took their third wife Priya Kapur to court over the division of their personal property.
According to a petition filed at the High Court in Delhi, whose copy of the Mint saw, Kapoor’s children – Samira and Kiaan – attacked the validity of the will used to transfer the property of Sunjay Kapur. According to the petition, the children said they had not yet seen a copy of the will, despite repeated requirements, and asked the court to provide one fifth of their share in their personal property.
The petition, which will probably be heard on Wednesday, is named Priya, her son Azarius Kapur, Sunjay’s mother Rani Kapur and Will’s executor Shardha Suri Marwah, CEO of the car manufacturer.
The will of 21 March said all the personal assets of Sunjay Kapura need to be converted to Priya Kapur. Children Karisma Kapoor says that the existence of such a will have never been revealed to them or their mother since the extinction of Sunjay Kapur 12. June.
According to the petition, there was a meeting at the Taj Mansingh hotel in Nový Delhi on July 30, where it turned out that Sunjay Kapura left the will that Priya gave all his personal assets.
The meeting was attended by Priya Kapur, its legal advisors, Marwah and other managers of Aureus Investment Private Limited, promoter Ena Comstar (listed as Sona BLW Precision Forgings Limited). Only during this meeting did the existence of the will that was known, according to the petition.
“Given that the plaintiffs were not told whether the supposed will was registered or not, the prosecutors really believe that it was not registered,” the petition writes.
According to Marwah’s petition, which is said to have attended the meeting, he allegedly mentioned during the meeting that she was informed of the will of July 29, the day before meeting with the Kaporo family.
A request for comment shared with Priya Kapur, Sona Comstar, Aureus Investment and Karisma Kapoor lawyers remained unanswered.
The petition also claims that Priya Kapur has previously denied the existence of such will and instead stated that all Sunjay Kapura assets are located under the RK Family Trust, a key entity that controls the greatest entity of the promoter Aureus. Samira and Kiaan are the owners of the RK Family Records together with Priya and Azarius Kapura.
The application is also appointed by two director of Aureus, Dinesh Agarwal and Nitin Sharma, who were charged with a collusion with Priya Kapur to help her transfer all personal assets for themselves and take control.
“The defendant No. 1, nor the individuals (ie Mr. Dinesh Agarwal and Mr. Nitin Sharma), with whom interactions have occurred in recent months, have revealed at any such alleged will at any time,” the petition reads.
The latest development in the Saga Kapura family comes when Rani Kapura and Mandhira Kapura, mother and sister Sunjay Kapur have already questioned control of Priya Kapura on Sona Comstar, where she was appointed as an inefficient member of the Board of Directors in July this year.
During the letter to the Council on July 24, Rani Kapur opposed the appointment and asked for the annual General Meeting of the Company, scheduled for July 25, which will be delayed. Mandhira questioned the validity of RK Family Trust and transfer ownership of the key organizing entity Sona Comstar.
Sona Comstar’s shares price on Tuesday dropped by 1.91% compared to a 0.02% decrease in Nifty Auto.
