The Supreme Court postponed the hearing of Waqf petitions until May 15, because the main judge of India Sanjiv Khanna quoted his upcoming retirement next week. The bench led by CJI published matters in front of the bench led by justice Br Gavai, who will have the office as the new main judge 14 May.
Hearing about WAQF petitions will now be listed in front of the bench headed by Judge Bhushan R Gavai 15 May.
“I do not want to reserve judgments or orders even in the interim phase. This matter will have to be reasonably heard on every date. It won’t be in front of me,” Hindustan Times quoted a bench headed by CJI Khanna.
The bench, which also includes Justices Sanjay Kumar and KV Viswanathan, said that when commenting on the responses submitted by the Center and the petitioner, “you raised valid points when registering WAQF and have also received some data that was also questioned by the petitioner.
The bench noted that exercise would become unnecessary with regard to limited working days CJI Khanna as a CJI. He said, “We will publish it in front of the justice bench Gavai for hearing on the interim and final order. I want to give him time to go through these documents.”
In this, the main advocate Abhishek Manu Singhvi, who appeared for some of the petitioners, noted: “The court has a quick way to get rid of us.”
While the leader of the champion Kapil Sibal, who appears for Muslim parties, reminded the top court that the reassurance of the center should continue until the next date of hearing.
“We would love you to convince you because every statement has an answer. It is painful to remind us of the date (your retirement). We cannot be ashamed because there is no time,” said general lawyer Tushar Mehta.
Previous hearing:
At the previous hearing on 17 April, the Top Court allowed the Center to answer several legal issues raised in more than 70 petitions filed in front of the bench. The bench filed on May 5 before receiving any order to consider an aspect of any temporary order. It also recorded the assurance of the provided WAQF status and the inclusion of non -Muslims in the Central Waqf and Waqf Boards, HT added.
Among other aspects of the call against the WAQF 2025 law, these were two questionable questions common to all petitions. In his SG Mehta arguments, he assured that no Muslim would be appointed to the Council or Council, and if the state would make any meetings, the same will be considered invalid.
He also assured that the user, including WAQF, including WAQF, whether declared by notifications or registration, will not be denotified or their character or status changes.
