
The Calcutus High Court ordered the Center to continue the implementation of the Rural Employment Act (MGNGA) Mahatma Gandhi in West Bengal from 1 August 2025 after nearly three years.
The divisional bench led by TS Sivagnanam High Judge and Judge Chaitali Chatterjee (DAS) has made it possible to store special conditions, restrictions and regulations – measurements that do not apply in other countries – to prevent repetition of inconsistencies during the system in West Bengal.
The court acknowledged that the Center identified certain discrepancies in paying wages under Mgnrega in the State. He noted that the measures had already been taken, billed and funded on the bank account of the State Node Agency.
The bench stressed that while investigating past misconducts, it is now focusing on ensuring efficient and without corruption without corruption.
The main judge Sivagnanam noted: “At this point, the court is concerned about implementing the system in West Bengal prospectively.” He added: “The scheme of the law does not assume a situation where this program would be stored for cold for eternity.”
The court also stated that the Center has sufficient powers to investigate any inconsistencies or illegality related to paying wage, but stressed that it is important to develop a clear limit between previous events and future design.
The bench concluded that the MGNGA restart directive in West Bengal is “in the public interest” and is in line with the purpose for which the central legislation has been adopted. He also allowed the authorities supervising this system to impose the necessary warranties to ensure that the discrepancies that occurred three years ago did not appear.
This decision comes in the middle of the ongoing tension between the State Government of the West Bengal and the Corruption accusation center and the Corruption accusation that has stopped the system since 2022.
