The Bharat Rashtra Samithi (BRS) has asked the State Election Commission to modify or withdraw the circular that had set February 14 as the cut-off date for furnishing details of ex-officio members for the Chairman/Vice-Chairman/Mayor/Deputy Mayor elections scheduled for February 16 and instead announced the cut-off date of February 15.
In a statement made before the SEC on Saturday, BRS General Secretary Ravula Chandrasekhar Reddy along with members of the legal cell of the party brought to the attention of the former member that under the Telangana Municipalities Act, 2019 and the rule contained therein, at least one clear day in advance is fixed for the issuance of Form II informing the Ex-Chairman/Municipal Mayor/Municipal Chairman for the election of Mayor.
As the special meetings of the recently elected Urban Local Bodies (ULBs) are scheduled for February 16 at 12:30 p.m., as per the one clear day policy – the statutory outer limit for issuance of Form II (by political parties), the deadline for furnishing details should be February 15 at 12:30 p.m.
However, an internal circular issued to the field officers directed them to complete the process of providing Form II by the parties by February 14. It was premature, contrary to the statute and likely to prejudice the rights of elected representatives and ex-officio members, said Mr. Chandrasekhar Reddy on behalf.
Stating that such instructions were contrary to the mandatory requirement of one clear day and could disrupt the entire election process, exposing the proceedings to an avoidable legal challenge, he asked the SEC to take urgent action in the interests of fairness, transparency and compliance with statutory provisions.
