On Thursday (September 18, 2025), the Bombay High Court dismissed the petition of the public interest (Pil), which attacked the decision of the Maharashtra Government to release Marathas Kunbi Caste, allowing them to take advantage of reservation and observe that the petitioner was not an “angpled person”.
The divisional bench of the chief judge Shree Chandrashekhar and the judiciary Gautam A. Ankhad stated that the right to question the government resolution consisted only with those directly affected members of other backward classes (OVC), who have already approached the court. Their petitions are listed before another bench of 22 September.
“At this stage, this litigation of public interest is thoroughly considered incorrect. It was open to the victims to question the government decision, not for any person,” said the bench. He also said, “Criminalization by law can only be adopted by damaged persons and these petitioners are not damaged by persons.”
Avoid “many times of disputes”
The court stressed that it was in the public interest to avoid the “multiple disputes” and discourage Pils, where the individuals concerned confiscated the court. “This particular drank is not the one where we should grant any leniency. We are therefore not inclined to entertain this drink, and the same is rejected,” the judges said.
He drank the defense counsel Vinita Vinod Dhotre, who claimed that the government resolution was arbitrary and unconstitutional. He claimed to be part of the planned caste, but the bench noted that it had no locus. Nevertheless, he gave him freedom to apply for intervention in petitions submitted by members of the Civil Code.
