“Threat for Public Order”
The prosecution strongly opposed bail, while the higher prosecutor DV Chauhan claimed that alleged steps were “a form of terrorism” and represented a threat to public order and security. As evidence of the involvement of the applicants, he quoted CCTV shots, mobile locations and WhatsApp called “Sunni Youth Force”, which was allegedly used to mobilize the crowd.
However, the defense counsel – including the higher defending champion of AV Gupta and others – faced that evidence, including records of call details (CDR) and delayed tests of test identification, did not justify the accused specific roles. They argued that the accused was arrested primarily for suspicion and spent more than three months in custody without court.
The attorney Mohammad Aadil Sheikh, who appeared for one of the accused, claimed that the probe was completed in this case, and therefore the accused should be awarded bail.
