The Bombay High Court rejected a petition on Friday (June 20, 2025) to seek the intervention of courts in its issuance as a certificate of planned caste (SC), claiming that because of his mother belonging to the SC community he suffered discrimination and disadvantages.
An 18 -year -old Bombai student submitted a petition through the defense counsel Nikhil V. Adkine against the government of the Maharashtra for Social Justice and the Special Assistance Department and the Committee on Certificates in the Raigad district.
Neel Gokhale and Revati Mohite Dere, dr. Neel Gokhale and the Revati Mohite, rejected the petition and noted that the petitioner had noticed any evidence to prove that his mother was a member of SC, suffered deprivation, humiliation, humiliation and any other challenges that usually suffered a person who belongs to the planned community. “His mother’s grandparents also do not live in the backward space, nor their living conditions are not without basic needs, food, clean water, hygiene and health care. Their lifestyle is satisfactory.”
The petitioner asked for a statement that he belongs to the “Chambhar” planned the caste community on the side of his mother and issuing a certificate of validity of the caste. His parents married in April 2004 in Pali in Raigad. While his father is one of the “Hindu Agri” caste, his mother comes from the “Chambhar” community, SC, both used in the central armed police power, under the Ministry of the Interior. At the time of admission to school, the son was registered under his father’s surname and caste. However, given marriage disagreement, parents divorced in 2016. When the petitioner was in high school, his mother admitted him in Kendriya Vidyalaya in Nashik under her surname, caste and also changed his name.
In the academic year, 2022-23, when the petitioner in Class 11 at Navneet Junior College of Arts, Science & Commerce in Mumbai, his mother asked for him for the “Chambhar” certificate. When the college director handed over the proposal to verify the check -up committee, in April 2024 the committee and the vigilation cell refused to grant the CASTE CASTE certificate.
Attorney Adkine said that despite the father belonging to the upper caste, he never cared about the petitioner or cared about him and never had any expenses. “He had no advantages in his life and suffered deprivation and indignation and humiliation as a member of the planned caste community.”
The bench noted that the control committee concluded that the petitioner did not suffer any humiliation or not deprived of good education. “His mother was still employed during her career in the port of the Central Police of Mumbai. There is nothing to suggest that the petitioner’s mother suffered any humiliation that was reflected in the petitioner.”
Another government prosecutor, BV Samant, pointed out that his father had made many attempts to meet his son, but his mother didn’t allow it. During his education, his father took all opportunities for his son. In addition, the mother works in the port of the Central Police Mumbai and earns considerable income to support himself and her son, and therefore did not apply to maintenance.
