Luigi Mangione lawyers asked Saturday’s federal judge in New York to dismiss some of the criminal charges, including the only number for which he could face the death penalty, from the federal indictment, which was against him at the Associated CEO.
The 27 -year -old accused, who grabbed international subtitles since Brian Thompson, after his deadly shooting, admitted that he was not guilty of state and federal accusations.
Why lawyers want to be federal fees rejected
Magione’s lawyers in documents filed in the federal court said that prosecutors should also be excluded from the use of statements made by officials in criminal proceedings, as well as his backpack, in which weapon and ammunition were found.
The lawyers insist that their client was not read his rights before the coercive officials questioned him, and even the other did not receive an order before looking for Mangione backpack.
Last month, Mangione lawyers asked for his federal accusation to be rejected and the death penalty should be removed from the table as a result of public comments by the US General Prosecutor Pam Bondi. In April, Bondi ordered the prosecutors in New York to seek the death penalty and call the Thompson for killing “the anticipated, cold -blooded assassination that shocked America”.
Which is the accusation for which Mangione could face the death penalty?
Murder cases are usually tested in state courts, but prosecutors have also accused mangione under the Federal Act on Murders committed with firearms within other “crimes of violence”. It is the only fee for which Mangione might face death penalty because it is not used in New York.
Posts filed early on Saturday morning argued that this fee should be rejected because prosecutors could not identify other crimes that would have to be condemned and stated that alleged further crime – persecution – is not a crime under AP.
How was Mangione caught
Soon after the killing of Thompson, more states started. The authorities knew that the suspect had skipped from the scene on a bike that went to Central Park before taking a taxi to the interstate bus warehouse.
Five days later, the McDonald’s tip led about 233 miles (375 kilometers) in Altoon in Pennsylvania for the arrest of Mangione. Since then he has been held without deposit.
