
Jammu and Kashmir High Court said on Wednesday (September 17, 2025) that the arguments of lease of Gulmarg rental and the public interest (saw) petitions on environmental issues would be heard at the next date of hearing because the next general lawyer (AAG) did not receive another written instruction.
The divisional bench, which consisted of the main judge Arnu Palli and Judge Rajnesh Oswal, postponed the Gulmarg Case to rent together with a request for drink until October 27 after the court heard arguments submitted by a higher attorney Mohsin-Howkat Qadri. Mr. Qadri reported the division’s bench that he had not received any instructions from the government, with the exception of the defense of the Grant 2022.
In August, the High Court was looking for the final attitude of the government and after two separate opinions presented by Raj Bhawan and the Office of the Main Minister in sealed covers. The Raj Bhawan stand was presented through the general lawyer and the position of the main minister through a special secretary of the legal department.
The leader of the lawyer Zafar Shah raised a point on the final position of the government in court. “We are not sure whether the High Court considers the last stand of the main minister or Raj Bhawan. We assume that two stalls were different and one favored the petitioner,” Shah said. He also explained that the stands of the Office of the Chief Minister or Raj Bhawan were not revealed to them.
Officials stated that the Office of the Chief Minister is favored by the Gulmarg Committee and the LG Office sought to introduce the rules of Grant Land Grant 2022.
Given that the final attitude of the government of Jamm and Kashmir is not submitted in court, the phase is ready to hear the arguments from both parties to decide on the matter.
Approximately 50 hotels in Gulmarg’s hotspot are unable to extend the rent period after the Governor Lieutenant (LG) developed new rules, Jammu and Kashmir replaced Jammu and Kashmir in 2022. Hoteliers are also worried about outsiders who will be able to participate for the first time. The new rules insist on open offering “any person legally competent pursuant to Section 11 of the Indian Party Act of 1872.” In the past, only the locals were eligible for such rent.
