NGOs (NGOs) were shifted by the Supreme Court questioning the constitutional validity of the WAQF law (amendment), 2025.
The Association for Civil Rights Protection stated that its reasoning reason is questioned by the constitutionality of the draft Act on the WAQF (amendment), 2025, which is to be renamed the unified strengthening of the position, efficiency and development Act on Development, 2025 (UPEED BILL).
“The bill directly violates Articles 14, 25, 26 and 300A of the Constitution, along with pre -brown values that make up the subsoil of our democratic and secular framework,” she said in her action brought through Adeel Ahmed.
He said that the drastic revision proposed by the UMEED law is not only unnecessary, but also an alarming interference with the religious affairs of the Muslim community and dilute the basic purpose of WAQF, which is a practice deeply rooted in the Koran’s legacy and the HADADH since the Prophet Mohammad.
“The bill has hurriedly passed Lok Sabha 3. April 2025 and Rajya Sabha 4 April 2025, is now on the verge of receiving the President.
The NGO further stated that the unauthorized omission of the provisions that serves the user’s doctrine is a deliberate weakening of the legal recognition awarded by the WAQF by real estate.
He stated that the removal of this provision thus represents an attempt to disrupt the basic principles protecting the properties of the WAQF and disrupts the gentle balance between religious autonomy and state supervision.
“The applicant humbly claims that the bill UMEED, 2025, is unconstitutional and unfounded by legislative overlap, which must be affected in order to comply with fundamental rights, individual freedom and religious autonomy under India,” he said.
The bill was approved in Rajya Sabha, while 128 members voted in favor and 95 against him. He was handed over in Lok Sabha and 288 members supported him and 232 against him.
