In significant development related to the rights of transgender, the High Court ordered the state authorities to issue a revised birth certificate of a child of a transgender couple who identified them as “parents” instead of a father and mother, Onmanorama reported.
The judgment was issued by Judge Ziyad Rahman AA on Monday on a plea submitted by Trans Man Hothad and Trans Woman Ziya Paval, who was looking for a gender neutral format in a birth certificate issued by Kozhikode Corporation as part of the rules of birth and death, 1999.
Kozhikode Corporation had previously released a birth certificate that mentioned Zahroad as Mother and Ziya Paval as a father, along with the term transgender in parentheses.
Gender identity
Trans couple protested against this classification and said it did not reflect their gender identity exactly.
“We are extremely happy from the judgment of the court. Trans couples like us may now decide to be recognized as” parents “instead of gender -specific identities such as” mother “and” father “. We gave the case soon after the birth of our child, ”said Ziya Onmanorama.
Ziya and Zahhad became the first Indian transgender parents at the birth of their child in February 2023.
In their petition, Kozhikode Corporation asked to avoid the name of her father and mother on her birth certificate because she identified herself as male years ago and currently lived as a male member in society.
“This is the main victory for the LGBTQ community. The certificate currently includes two slots -the mother’s name, the father’s name. This will change for transformations since.
Their lawsuits were filed by advocates Mariam, Padma Lakshmi and Ipsita Ojal.
