The Court of Appeal for the income tax (ITAT) dismissed the appeal of the Congress Party, which sought exemption from income tax for income £199.15 Crore during the 2018-19 evaluation year.
The Tribunal rejected the party’s claim for exemption due to the fact that in Section 13a of the Income Tax Act there was a breach of conditions.
“The return of the assessed submitted on 2.02.2019 is not within the date of the” maturity “to be eligible for the attacked exception,” Itat said in the order issued on July 21, according to the NDTV report.
The Congress Party filed its income tax return on February 2, 2019, too after the due date of 31 December 2018, and declared zero income. He also claimed an exception £199.15 crore.
Pursuant to Section 139 (4)), however, the political parties must submit their revenues to the ‘due date’ in order to qualify for this exception. ITAT refused the argument of the Congress Party that a delayed return, such as allowed for charity trusts according to section 12A, should be enough.
After the assessment has elapsed, it also indicates cash donations £14.49 Lakh, each exceeding the permissible limit £2,000. The tribunal found the congress in violation of this provision and stated: “Gifts beyond the scope £2,000 cash received in cash is violated by the clause d) of the first provision of section 13a of the Act, ”said the report in Times of India.
