Telangana HC dismisses Margadarsi’s petition challenging ₹81.12 crore cross subsidy charges

The Telangana High Court dismissed a plea filed by M/s Margadarsi Chit Fund Private Limited challenging the calls issued by Margadarsi Chit Fund Private Limited for payment of cross subsidy charges of Rs.81.12 lakhs for the financial years 2005-06 to 2014-15.

Dismissing the chit fund company’s petition, Justice Nagesh Bheemapaka of the Supreme Court said the petitioner had not made out any case for interfering with the applications issued by the power distribution company. In his order, the judge said that a consumer seeking exemption from cross subsidy charges should certify to the authority issuing the demand that his producer has a valid approval issued by the state government under Section 43-A (1) (C) of the Electricity Act-1948.

The chit fund company’s argument that GO 93 of 1997 and 112 of 1998 (cited by them) asserts that there is consent cannot be accepted, according to the judge. The petitioner sought time to submit consent under the Electrification Act but could not do so, the verdict said.
