District collectors will have a key role in the registration of new WAQF properties and the view of government real estate complaints that are identified or declared WAQF, according to the WAQF rules.
The Government of the Union was looking for the opinions of the state governments and the state councils of WAQF on the proposal for the WAQF Act (amendment) 2025, which was approved by Parliament in April. The rules will come into effect as soon as they are informed in the Indian Bulletin.
The collector will ask for the authenticity and validity of the application for the registration of the new WAQF in accordance with the income laws and confirms that WAQIF (one who does WAQF) is the legal owner of the property and competent to donate it as WAQF. The collector also discovers that the proposed assets are not a government, a protected monument or a protected area under the Act on the Preservation of Ancient Monuments of 1904 or ancient monuments and archaeological sites and remains the law and does not belong according to planned tribes.
Kerala was very waiting for the introduction of the rules, because Kiran Rijija, Minister for Minorities of the Union, said at the beginning of this year that the enactment of the rules would help residents of Munambam in their legal struggle to restore income rights of their possession. The inhabitants opposed the decision of the Board of Directors of Keral Waqf when notifying the land as the property of WAQF. Two petitions questioning the decision of the Board of Directors are waiting for the WAQF court. The inhabitants who claimed that they had purchased from Farook College, Kozhikode, protested for 240 days.
Portal, database
15-point rules also talk about the portal and database settings to submit details of WAQF and register New WAQF. There are provisions for monitoring the registration of the new WAQF in real time and submitting details of WAQF, litigation and resolution of disputes and resource management.
The District Collector may order an investigation to notify the official that any government assets have been identified or declared WAQF. The designated officer will hear all the persons in question or any person who is interested in property, including the government and Mutawalli Waqf, and ask them to submit their demands and anti -Strums in the specified period. The investigation should be completed within one year, says the proposal rules.
