Telangana High Court directs government to file writ petitions against bail for two BRS MLCs

Justice BR Madhusudan Rao of the Telangana High Court on Monday directed the state government to file written submissions in a criminal petition filed by the police department seeking cancellation of bail granted to two BRS MLCs Tata Madhusudan and N. Naveen Kumar in the criminal case against them on charges of abusing the Assembly Speaker.

The plea was filed by Deputy Commissioner of Police Sultan Bazar, the investigating officer of the criminal case, seeking cancellation of the bail granted to the two MLCs by the First Additional Chief Metropolitan Magistrate of Hyderabad on September 8. The State Attorney for the Interior, who appeared at the police department, sought the cancellation of the bail, claiming that the two lawmakers had deliberately abused the authority of their constitutional officer.

It was a deep-rooted conspiracy by the two MLCs to tarnish the speaker’s image, PP said. However, the legislators’ advisor TV Ramana Rao refuted the allegations. He argued that the two MLCs did not indulge in using abusive language. In fact, it was the assembly marshals and police personnel stationed at the main entrance of the assembly who misbehaved with the lawmakers. Since the lower court had refused to remand the two MLCs after they were produced before the court, the question of cancellation of bail would not arise, he argued.

The judge sought to know from Nageshwar Rao whether the two MLCs were issued a mandatory notice under Section 35 (3) of the BNS as the punishment for the said crime was less than five years. The PP said there was no need to issue the said notice as the crime attracted provisions of the Prevention of Atrocities Against Scheduled Castes and Scheduled Tribes Act. The judge adjourned the matter to November 2 and ordered PP to file written submissions in support of the cancellation of the bail.

Referring to another criminal petition filed by two MLCs to quash the First Information Report (FIR) issued against them, the judge issued a notice to the police department to file a reply in the matter. The hearing of this plea was adjourned until November 16.
