The Communist Party of India (CPI) wrote MP P. Sandosh Kumar to all political parties seeking to support the indictment against the judge of the High Court in Allahabad Yashwant Varma, who was charged with a block of probes with the Supreme Court after his residence in Delhi.
His letter comes in the background of reports that the government is likely to introduce a proposal for indictment in the upcoming monsoon meeting of parliament. Mr. Kumar is the second member of Rajya Sabha, who increased this demand. Last week, the Congress of Vivek Tankha, in the letter to the chairman of Rajya Sabha Jagdeep Dhankhar, asked the question that the parliament himself had the power to initiate the proceedings, yet the investigation report was not shared with the “constitutionally authorized body”.
Former Chief Judge India Sanjiv Khanna handed over a copy of the report on the Supreme Court’s investigation report, along with the recommendation to initiate the indictment against the judge, the President of the Murm and Prime Minister Narendra Modim.
“If it turns out to be true, these accusations are not only a gross betrayal of public confidence, but also a serious insult to the integrity of our court institutions,” Mr. Kumar said in his letter, calling on all political parties to increase and take over the constitutional responsibility for the protection of Indian judiciary.
By calling the provisions of Article 124 (establishment of the Supreme Court) and Article 218 (provisions concerning the removal of judges) of the Constitution for the purpose of initiating the indictment proceedings, Mr. Kumar said: socially representative ”. Mr. Kumar added that the judiciary remains opaque in his appointment and to a large extent unrepresentative.
“Our courts must reflect the multiple character of Indian society. The liability mechanisms for higher judiciary have long been delayed. What we face today is not an isolated case of alleged corruption – it is a systemic failure that requires both institutional reform and democratic will,” he said.
