The YouTube channels in India have complained over the past week that Newswire Asian News International (or) threatens them to issue complaints against copyrights for the use of shots that are published without licensing arrangements. The agencies neither and Newswire deal with journalists, photographs and videographs, along with journalists from other publications and symbol their news to others for a fee.
The agency requested damage requirements and license fees to use their content from YouTubers who used their shots without paying a license fee. Newswire reportedly demanded 48 Lakh Plus GST for annual license for reducing damages, a requirement for YouTubers like Mohak Mangal to attack. “(T) His action violates the creative statement and determines the wrong precedent,” Mr. Mangal said in a letter to the Minister of Information and Broadcasting Ashwini Vaishnaw.
YouTube allows copyright holders to entertain videos on the basis of copyright dispute or allow them to send complaints that lead to “strikes”, three of which can lead to youtube channels within 90 days and put pressure on channels to achieve the negotiations with copyright holders.
YouTubers, such as Mr. Mangal, whose video of his experience with such a request received 4 million views in two days, said the shots of his channel were very short and made “fair use”. Fair use refers to the use of copyright materials in a way that does not mean that the copyright does not mean copyright infringement.
India fair use or fair business framework liberates personal use, criticism or review, reproduction in court proceedings and “reporting of current events and current matters, including reporting a lecture presented to the public”. These exceptions are determined in accordance with Section 52 of the 1952 copyright Act.
“We are working hard to settle the rights of copyright holders with creative persecution of the YouTube community,” Youtube spokesman said. “It is not up to YouTube to decide who” owns “content and therefore we provide instruments for copyright holders to issue copyright claims and record tools that question the claims that are incorrectly filed.”
