Eligible Class Members may request two types of cash payments. People who experienced documented losses related to fraud or identity theft associated with the breach can seek compensation of up to $3,500. The settlement administrator said claimants must provide documents such as bank statements, receipts, invoices, phone records or other evidence of unreimbursed expenses related to the breach.

Who is eligible and how to apply

Those who did not suffer documented losses may still be eligible for an estimated cash payment of about $75, according to the settlement’s FAQ page. The final amount may vary depending on the number of valid applications.

In addition to monetary compensation, all eligible class members may receive one year of free credit monitoring services. The settlement’s website says affected individuals will need the activation code included in their notice to sign up for the service.

Fox 5 Atlanta reported that the application deadline is approaching, and noted that some eligible individuals could receive payments of up to $3,500 under the terms of the settlement.

Claims can be filed online through the official Krispy Kreme Data Incident Settlement website or mailed to the settlement administrator in Portland, Oregon. The deadline for filing a complaint is June 22.

The settlement administrator added that class members who want to opt out of the settlement or object to its terms have until June 6 to do so.

A final approval hearing in the case is scheduled for July 6 in federal court in Charlotte, North Carolina. According to the settlement’s website, payments and benefits will be distributed only if the court gives final approval and any appeals are resolved.
