Kerala BDS student death: HC directs investigating officer, special court to produce documents on arrest of Dr. Rama

The Kerala High Court directed the investigating officer and special judge under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, Thalassery, to produce documents showing that all pre-arrest formalities were followed in the arrest of Dr. MK Rama, the main accused in the death of Nithin Rajrak, a first year medical student of BDS Kannur.

Single Judge A. Badharudeen observed that “serious allegations” had been leveled against the investigating officer in the matter of the release of the accused and expressed suspicion that the release of Dr. Ram was implicated by top officials to “save” him from being detained.

Mr. Ram was arrested on July 19 and later released by a special judge on July 20 when he found that the reasons for the arrest were not communicated to the accused by the investigating agency.

He had earlier sought anticipatory bails from the Special Judge, the High Court and the Supreme Court but was rejected at all levels.
