Kerala HC approves state circular on appointment of public prosecutors

The Kerala High Court has approved the state government’s draft circular on guidelines for appointment of public prosecutors in district courts, ordering that the opinion of the district judge should prevail in preparing the panel of candidates.

Chief Justice Soumen Sen and Justice Syam Kumar VM passed the order while disposing of two public interest litigations seeking directions for appointment of government advocates and public prosecutors.

The court approved the draft circular after ordering that the term “due consideration” be replaced by the term “due preference”, giving priority to the opinion of the district judge in the preparation of the panel for the appointment of prosecutors.
