HC reserves orders in Bandi Bageerath’s bail plea in POCSO Act case

Justice K. Sujana of the Telangana High Court on Monday reserved orders in a criminal bail petition filed by the son of Union Home Minister for Home Bandi Sanjay Kumar Bandi Bageerath in a case registered under the Protection of Children from Sexual Offenses (POCSO) Act.

As the arguments of senior counsel for the petitioner S. Niranjan Reddy, public prosecutor for Home Palle Nageshwara Rao and counsel for the victim’s mother (complainant in the case) Pappu Nageshwara Rao were over, the judge reserved the orders in the case. The petitioner’s counsel argued that Mr. Bageerath was imprisoned for more than 49 days.

The police closed the investigation and a criminal complaint was to be filed in the case. At this stage there was no need to keep his client in prison; he argued. He told officers that nowhere in the complaint did it mention that the victim was sexually assaulted.

He said that the provisions of the POCSO Act could not be applied to this case as the alleged accused and the victim were in good standing till the case was registered. According to him, the investigators have already heard 22 witnesses in this case.

The domestic prosecutor strongly opposed granting bail to the accused, arguing that there was a greater likelihood that the accused would tamper with evidence and try to influence witnesses in the event of bail.
