Police say conspiracy behind attack on ED officials, blames ex-prosecutor for misleading trial

The Special Public Prosecutor in the case related to the alleged attack on Enforcement Directorate (ED) officials during a raid at the residence of Leader of the Opposition Pinarayi Vijayan on Friday has accused former public prosecutor T. Geena Kumari of misleading the court.
Special public prosecutor A. Santhosh Kumar, who was appointed after Ms. Kumari’s removal, argued before the District and Sessions Court in Thiruvananthapuram that the former prosecutor had wrongly stated that the investigation had been completed even though it was still ongoing. The alleged misrepresentation resulted in the grant of bail to the ninth accused Harish Kumar, he said.
The submissions were made during hearings on the bail applications of 10 accused in the case. He argued that the offenses committed by the accused were serious and alleged that there was a larger conspiracy behind the incident. The prosecution, which also sought cancellation of the bail granted to Mr. Kumar, said investigations were still on, including examination of phone records of the accused.
It was further stated that such politically motivated attacks which undermine the authority of central investigative agencies should not be taken lightly. Besides, granting bail to the accused could send a wrong message in such cases.
Rejecting the defence’s contention that the remaining charges should also be granted bail as the ninth accused had already secured relief, the prosecutor said each bail application must be considered separately. He also urged the court to examine the video footage of the alleged attack before deciding on bail applications.
The court reserved its order and posted the matter to July 6, when it is expected to rule on the bail applications of the accused.
