Justice Venkata Jyothirmai Pratapa on Wednesday reserved the verdict in a plea filed by former MLA Alla Ramakrishna Reddy for handing over the Amaravati Internal Ring Road (IRR) scam case registered in 2022 to the CBI.
N. Chandrababu Naidu, who was the Leader of the Opposition at the time, is one of the main accused in the case.
Justice Jyothirmai heard the main plea seeking transfer of the case from the CID to the CBI, along with two other related petitions, including one to cancel the anticipatory bail earlier granted to Mr. Naidu, and reserved judgment in all of them.
Advocate Jada Sravan Kumar, appearing for the petitioner, argued that the case should be assigned to the CBI as a fair investigation was not possible as the investigators were effectively working under Mr Naidu, who is the current Chief Minister.
He objected to the case being closed after the government changed in June 2024, on the grounds of a “factual mistake” and that Mr Naidu had breached bail conditions.
Senior advocate Mukul Rohatgi insisted that the petition to hand over the case to the CBI was not maintainable as a “factual error” report had already been filed in the Vijayawada ACB court and the state police (CID) was conducting an impartial investigation.
He contended that the petition of Mr. Ramakrishna Reddy was politically motivated and had no justification to grant his plea.
