On Tuesday (February 10, 2026), a bench headed by Chief Justice Surya Kant agreed to list for hearing a separate plea by Communist Party of India (Marxist) and CPI leader Annie Raja seeking action against the chief minister over a viral video allegedly showing him aiming and firing a rifle at members of the Muslim community.
On Wednesday (February 11, 2026), the Bench was asked to list the fresh plea along with the application filed by the Left leaders. “We will see,” said the CJI.
The fresh petition was filed by former professor Hiren Gohain, former DGP Assam Harekrishna Deka, senior journalist Paresh Chandra Malakar and senior advocate Santanu Borthakur.
The suit alleged that the chief minister had repeatedly made statements inciting discrimination, social and economic boycotts and violence against Muslims of Bengali origin in Assam.
It alleged that Mr. Sarma had propagated enmity and hatred on the basis of religion, language, place of birth and residence in his public speeches and media interactions.
The suit says the chief minister allegedly used terms like “Miya” and “Bangladeshis” against Muslims of Bengali origin in Assam.
