The Kerala High Court has stayed the demolition of Chander Kunj Army Towers

A division bench of the Kerala High Court on Monday ordered a stay on the demolition of Chander Kunj Army Twin Towers in Vyttila, developed by the Army Welfare Housing Organization (AWHO).

The temporary stay was ordered following an appeal by PK Unique Projects Limited, which was placed first in a financial competition for a tender for demolition work. The appeal was sought against the Single Bench order directing the committee headed by the District Collector to proceed with the demolition by Edifice Engineering, which was placed second in the financial bid.

The court said that the district administration can continue with the preparatory work before the demolition. However, the demolition should be stopped until the Single Bench conducts a detailed hearing and takes a final decision on the matter.

The petitioner company had earlier sought a direction from the Single Bench to issue a ‘work certificate’ for the demolition and stay the committee’s decision to finalize the demolition tender in favor of the other firm. The state then claimed that the contract was awarded to Edifice Engineering in view of its technical expertise in the safe demolition of buildings without any impact on adjacent structures and that Edifice was working on the demolition of four apartment complexes in Maradu.

Citing significant structural problems, the High Court earlier this month ordered the demolition and reconstruction of the towers, which housed apartments owned by 208 people.
