A Rouse Avenue court has ordered the release of Christian Michel James in a money laundering case related to the AgustaWestland helicopter business, expressing satisfaction with the court’s decision. He expressed satisfaction with the court’s decisions and praised the Constitution of India, ANI reported.
James was released on bail in a case related to ₹3,600 crore AgustaWestland helicopter deal registered by the CBI in 2013. The helicopter’s flying height was allegedly lowered to enable the supplier to secure the bid. It is also claimed that ₹200 million in bribes were paid in this deal.
“…There are some good judges in India…I am satisfied with the orders of the court. The Constitution of India is excellent,” Christian Michel James told the news portal.
Though he will remain in custody due to the CBI case. A similar application is still pending in connection with the CBI case. James asked to be released, claiming he had served the maximum 7-year sentence in the money laundering case. He was granted bail by the Supreme Court in the CBI case and the Delhi High Court in the money laundering case.
Earlier, Special Judge (CBI) Sanjay Jindal, after hearing the opening statement of the counsel for the accused Christian Michel James, asked the CBI to respond. The CBI has until December 22 to submit its reply.
Advocate Aljo K Joseph noted during the hearing that the investigation has been going on for the past 12 years without resolution. Christian Michel James has been in custody for seven years and the investigation into his involvement is still ongoing. Premier agencies are currently investigating the case.
“What do you want? Under what conditions can he be released from prison?” the news portal quoted the court.
James’ attorney argued that the court has a duty to ensure that no one remains in custody after serving their sentence. During the hearing, James expressed his willingness to participate in the trial if he was released.
He also mentioned that Christian Michel James was extradited to India in December 2018 and has already served the maximum sentence related to the charges against him.
Meanwhile, senior advocate DP Singh, special public prosecutor for the CBI, countered the arguments and argued that the accused should not be released, citing fears that he might abscond if released from custody.
The lawyer assured that Christian Michel James will attend the trial if he is released from custody.
James, a British national, was granted bail by both the Supreme Court and the Supreme Court. They required him to furnish a bond of Rs. five million in each case and surrender his passport. He did not post bail and his passport expired during his detention in the case.
