The Kerala High Court stayed for three months all further proceedings of the Malappuram First Class Magistrate’s Court against Hindu Aikya Vedi leader KP Sasikala, who was charged under Section 153 of the IPC for allegedly making a provocative speech intended to create communal disturbances in Malappuram on 31 August 2022.
It argued before the High Court that the First Information Report on the matter did not disclose any of the essential statutory ingredients required to file a claim under the section. The accusations reflected a subjective perception of hurt feelings, she said, adding that she never called for violence.
