
Umar Khalid, one of the accused in the larger northeast Delhi riots conspiracy case, has sought interim bail to attend his sister’s wedding. The suit was filed in a Delhi court on Tuesday. Umar Khalid applied for bail for 16 days – from December 14 to 29. His sister’s wedding is scheduled for December 27.
Additional Sessions Judge (ASJ) Sameer Bajpai of Karkardooma Court is scheduled to hear the plea on December 11.
Umar Khalid is accused in a larger conspiracy case linked to the Delhi riots. Along with other accused, he was charged under the Unlawful Activities (Prevention) Act.
Umar Khalid was granted interim bail two years ago for his second sister’s wedding.
His earlier bail pleas were rejected by the Delhi High Court and the Karkardooma court.
Sharjeel Imam, Tahir Hussain, Shifa Ur Rehman, Abdul Khalid Saifi, Meeran Haider, Natasha Narwal, Devangana Kalita and others are further accused in this case.
Earlier in November, the Delhi Police informed the Supreme Court that the trial of several accused, including Umar Khalid and Sharjeel Imam – booked under the UAPA in the 2020 Delhi riots case – was likely to be completed within two years.
The Delhi Police issued the clarification as it continued its arguments against the bail applications of Khalid, Imam and five other accused in the 2020 Delhi riots case.
Following the police submission, the Supreme Court heard counter arguments by senior advocates Kapil Sibal and Abhishek Manu Singhvi, who are appearing for some of the accused.
ASG Raju had earlier said that the first charge sheet against the accused was filed on 16 September 2020 and the supplementary charge sheet was filed on 22 November 2020.
ASG further stated that according to ยง 16 paragraph 1 letter (a) UAPA, whoever commits an act of terrorism may be punished and there is no bar which stipulates that the sentence of imprisonment in such cases shall not exceed five years. On the other hand, the UAPA provides for a minimum sentence of five years, which can be extended to life imprisonment.
