A Delhi court on Wednesday asked the CBI to respond to a plea filed by former Bihar Chief Minister Rabri Devi seeking transfer of the IRCTC hotel scam case to another judge.
Chief Justice and Sessions Judge Dinesh Bhatt heard the Rashtriya Janata Dal (RJD) leader’s plea and issued a notice to the Central Bureau of Investigation (CBI).
However, the court refused to stay the ongoing trial in the CBI case.
Earlier on Monday, she had filed a plea seeking transfer of the CBI and ED cases registered against her to another court, saying she had reasonable apprehension that “fair and impartial justice” would not be done.
The former Bihar chief minister is named as an accused in four cases, including the land for labor and IRCTC scam case, which is being heard by special judge Vishal Gogne.
Plea filed by Rabri Devi before the Chief District and Sessions Judge: “The applicant (Devi) has a bona fide and reasonable apprehension that the Special Judge will not do fair and impartial justice and that the conduct of the Special Judge during the proceedings in all the cases appears to be unduly in favor of prosecution and partiality which can be seen from the number of cases.
The plea argued that there was a “reasonable apprehension of bias” and that in the interests of justice the cases should be transferred to another court of competent jurisdiction.
The judge then scheduled the case for further proceedings on December 6.
