Priya Kapura, the widow of the late Sona Comstar Sunjay Kapur, said on Wednesday Delhi High Court said that Karisma Kapoor and her children did not legally doubt the attacked will and caused the accusation of counterfeiting “false” and without any legal basis.
The head of the lawyer Rajiv Nayar, who showed a submission on behalf of Priya Kapur before Jyoti Singh, said that the claims for counterfeiting are “unfounded” and lack a legal basis.
He claimed that Karisma Kapoor and her children formally doubted the will in their plea, nor did they look for any statement to cancel it. “The whole action is without any cause of the action. There is no call for this will,” Nayar said.
“The action was filed on 9 September, but there is no reference or call for will in the lawsuit … At every stage, a request for a substantial assault is missing. There is no replication to refute the written statement.”
Nayar also pointed out that the will of 21 March was published to all parties and read in their presence on July 30.
“The will is dated 21 March 2025 of my deceased husband. Just before that I published the will of 30 July. There were two opportunities for the plaintiffs. The will was read to everyone, including the plaintiffs. Everyone knew the will of Sunjay Kapur existed,” Nayar added.
The solution to the fact that minor errors could invalidate the will was that the rights of law, such as spelling errors, incorrect addresses, or the use of “testatix” instead of the “testator”, are not valid for the cancellation of will.
The High Court postponed the hearing until Friday.
Priya Kapura’s submission came in response to the accusation of the Kapoor Kapoor children through the higher defense attorney Malesh Jethmalani during the previous hearing.
Jethmalani claimed that the will was created and described the situation as a “extended plot” that could represent a criminal offense under Section 467 of the Indian Criminal Code, which sets a life imprisonment for the creation of will. During hearing of October 9, he claimed that Sunjay Kapur had no role in designing or adjusting will.
The Word Microsoft document was reportedly changed on March 17, 2025, while Sunjay was on holiday.
