On Tuesday (October 7, 2025), the Supreme Court reminded the Indian Election Commission that “the degree of transparency and access to information is characterized by the characteristics of open democracy”. He also questioned the top survey authority to individual details of voters added to the final list of voters in Bihar after a special intensive revision (Sir) of the state election role.
In the final role, more than 21.5 lamp selectors and 3.66 lakh were added.

The final list shows that there are 7.42 eligible voters in the state. This was higher than 7.24 Crore voters listed in the electoral role published after the first SIR phase, which recorded the removal of 65 Lakh names, since Bihar had 7.89 Crore voters, which is the Sir announcement date.

Using the right to appeal
The Court asked the EC whether the voters of the 3,66 Lakhs removed from the final list were individually informed by means of a formal deletion order to facilitate the filing of appeal against their exclusion.
“They have the right to appeal,” Kant EC said.
The bench also asked whether a separate list of names and details of the excluded voters was published 3.66 Laky and was easily accessible at the local level. Justice Bagchi referred to the rule 21a registration of the 1960 voter voters, which requires the survey authorities to issue the names and details of deleted voters on the wall boards of the district election agencies.
“No complaints”
Senior defending champion Rrakesh Dwivedi for EC said that the scattered data were still collected from ground officers and processed. In the final list, however, there was no single complaint against any exclusion of names, he said that the final election roles have already been shared with political parties.
“Who is deleted and who is not only requires a basic comparison between the concept and the final list,” Dwivedi said.
At one point of hearing, the Kant’s judiciary threw the argumentation of the EC lawyers, the advocates of Prashant Bhushan and Non Rathi.

“Estimate of the population”
Mr. Bhushan said that Sir, instead of cleaning the electoral process instead of cleaning the electoral process process, enhanced problems only because of EC opacity.
The court asked EC to solve the problems raised in written submissions on Mr. Bhushan on Thursday.

Sir’s exercise also resulted in a disproportionate exclusion of Muslims, Mr. Bhushan said. “Our analysis based on name recognition shows that Muslims were 25% among 65 Lakh voters excluded from role designs and 34% of 3.66 lacquers deleted voters from the final roles … This disproportionate exclusion is a reduction in about six Muslim voters.”
The court asked EC to answer Mr. Bhushan’s analysis that at least 5.17 names on the last roles are duplicates. “There are more than 2.5 lakh cases of empty or unhealthy households, more than 25,000 voters with Gibberish names and nearly 60,000 invalid posts or relationships or gender relationship,” they said.
The court published the case for further hearing on Thursday.
