
On Thursday, the Kerala High Court challenged the lawyer for filing a drank against the book by Arundhati Roy Mother Mary Mary coming to me, which contains a cover image of smoking without considering the exclusion of responsibility for smoking printed on the rear envelope, as Livelaw says.
The court heard a petition looking for a stay in the sale of a book unless there was a legal warning.

During the hearing of the division bench, including chief judge Nitin Jamdar and Justice Basant Balaji pointed out the petitioner that he had not even submitted the book before court. In response to this, the petitioner explained that he had visited a bookstore and took a photo of the envelope, Livelaw informed.

As Livelaw states, the court then said orally: “We haven’t been shown … There is one more option that we have also indicated. The last time there is an authority. Do you want to go there? Isn’t that right. You should at least deal with it.
The court then ordered the petitioner to seek out whether it intends to approach the competent authority within cigarettes and other tobacco products (advertising and regulation Act, production, offer and distribution) (COTPA) (COTPA), and came out.

When the matter was reopen, the court asked the petitioner’s Council whether he intended to argue about merit or contact the relevant authority under the law.
Meanwhile, respondent No. 4, Penguin Random House India pvt. Ltd., the publisher, submitted a photo of the back cover of the book in its countermeasures and showed a renunciation of responsibility that reads: “Any smoking in this book is only for representative purposes. Penguin Random House India does not support or approve of tobacco.”
Penguin also asked the court to place the exemplary costs of filing a frivolous saw on the petitioner, Livelaw reported.
The bench then questioned the proposer’s council on why the existence of the exclusion of liability was stated in the petition. In response, the advisor admitted that the petitioner did not pass through the whole book and saw only the front envelope.

As Livelaw states, the court noted in his order: “The appointed advisor to opponents 4 has a serious objection that he has been submitted without proper research without noticing the exclusion of liability in a book by a publisher that is not to support publishing. He intends to argue a matter of merit … The petitioner also reminds that the opponent is looking for exemplary costs… ”
The journey Arundhati Roy to write Mother Mary comes to me in September 2022, after the death of her mother Mary Roy, from whom she was stolen from the age of 18.
