The leader of the opposition of Suvend Adhikari presented a written response to Bharatiya Janata’s party (BJP) to the Trinamool Congress in front of the High Court in Calcutta.
At least eight MLAs were publicly joined to the Trinamool Congress, which attacked elections to the assembly of 2021 on the BJP ticket. Despite switching parties, legislators continue to participate in the proceedings of the State Assembly, some of which are also appointed to the Assembly.
The Party of BJP legislators previously turned to Biman Banerjee and was looking for disqualification of defect MLA. Without a positive answer, the party moved to the High Court.
The divisional bench of justice Debangshu Basak and justice Mohammad Shabbar Rashidi closed the hearing last week. When reserving his judgment, the court allowed the submission of written statements.
The opposition MLA defction against the ruling Congress of Trinamool was a recurring problem in the state. After crossing, the MLA not only avoided the law against the defect, but also hold positions in key domestic committees.
Since 2011, when the Trinamool Congress came to power, almost 50 mills from opposition parties have joined the ruling camp. In 2011 and 2021, most of the defects came from the left front and CPI congress (M), while after 2021 the legislature of BJP was largely. Not a single had to disqualify due to defection.
The case in front of the High Court in Calcutta brought considerable political attention. Observers note that the judgment not only determines the fate of several legislators, but could also form the implementation of the Anti-Defa Act in West Bengal.
