
In the last change in US policy Visa Administration said on Friday that it will allow children to hold H-1B visa holders from their protected legal status because their parents are applying for green cards.
The Ministry of Internal Security (DHS) stated in a statement that it regulates the administration of Joe Biden, which protected young adults from submission of their legal status if the petition of parents were still processed when their children reached 21 years.
It coincides with recent changes in American citizenship and immigration service (USCIS), which corresponds to the regulatory orders of President Donald Trump to tighten immigration control.

About a new change of USCIS policy
This latest change in US citizenship will affect the people to which the Child’s Status (CSPA) Act (CSPA).
In February 2023, former US President Joe Biden’s Administration expanded CSPA protection, allowing certain children to remain eligible for green cards as soon as their parents become qualified.
The aim of this policy change was to prevent children from getting older because of lengthy immigration pending.
However, Trump’s administration withdrew this extensions on Friday and stated that the CSPA provisions would be provided again when the visa was made available through the Foreign Ministry.
According to USCIS, this would determine a more uniform process for individuals looking for immigrant visas and adaptation.

The extended waiting period for a change in their status, especially in persons with H-1B and other temporary visas, can now lead to a dependent child to lose their legal status.
Maybe they will even have to leave the US when they are 21 years old, even if they spent most of their lives in the country.
