
The Federal Court of Appeal threw the judge’s finding the “likely cause” to hold Trump’s administration officials in criminal contempt by the court for sending the accused members of the Venezuelan gangs to the prison of Salvador, despite the order of stopping deportation.
Order 2-1 on Friday means that American officials are no longer impressed by further investigation of contempt or the possibility of prosecution under the previous decision. In April, the US district judge James Boasberg in Washington, Washington, closed in his opinion that officials acted in “deliberate ignoring” of their verbal order on March 15 to turn the aircraft carrying Venezuelans to Salvador.
Judge Greg Katsas wrote for the Court of Appeal that in Boasberg’s timely treatment of deportation, there was a “fatal ambiguity” to the extent that the actions of Trump’s administration were “clearly and undoubtedly” were not a criminal.
On Friday, Boasberg also brought another decision that the Venezuelans were entitled to the opportunity to return to prison in Salvador’s prison. The judges said that since these individuals have been sent to Venezuela and released since then, Boasberg’s earlier decision was “overtaken by events” and could no longer stand.
The US Court of Appeal sent the case back to Boasberg to re -consider what kind of relief is now appropriate.
